Obstruction query-3ft as long as opponent has the ball?

If a player has the ball is it ok for an opponent to be less than 3ft from them if their hands are down ( not marking the ball). The opponent is facing them but not extending their hands in any way.

  1. 16.3 A player may be within 0.9 m (3 feet) of an opponent
    in possession of the ball providing no effort is made to intercept or defend the ball and there is no interference with that opponent’s throwing or shooting action.
